My passion lies in constitutional law and comparative constitutional law research. I focus on the nexus between theory and practice, opting to examine theoretical matters that explain real world events with strategic significance. I seek to not only make sense of what has already transpired but enhance the decision makers and the public’s understanding of the implications of their actions. This, in turn, will also hopefully inform and shape their future actions. Over the last few years, I have split my attention between contributing to the discussion on unfolding constitutional crises in the US, the UK and Israel. Overall, my research has dealt with many countries worldwide, offering theoretical, comparative analysis that is relevant across the board to all constitutional regimes.
I love busting myths, shifting paradigms, flipping familiar concepts and upending the common perception of the legal, political and judicial circles as well as of the public at large. Our understanding of the world and our analysis as researchers relies on certain axiomatic assumptions, which I enjoy challenging. Among the notions I have challenged: the US and UK constitutional models are polar opposites; constitutions may only be adopted within a short window of opportunity in the aftermath of a great revolution; constitutions cannot be adopted via an evolutionary process; constitutional conventions and special ratification processes are the only qualified expression of the will of a sovereign nation; the paradigm for bargaining with terrorists; the perception that secession may align with constitutionalism; the argument that most countries allow for secession in their constitutions; the idea that militant democracy is only about protecting democracy and is achieved only by bans on political parties; the idea that popular sovereignty is focused on the people alone, rather than the people+territory; the notion that United Mizrahi Bank adopted the Constituent Authority theory to explain Israel’s constitutional development.
